    Fled with kids
    My daughter-in-law just took the kids out of state to her mothers home in Florida. She did not tell my son or give any hint that she was going to do this. What legal recourse does he have. Can she do this with the kids?

    Are they married? If not, is there a visitation schedule in place?

    Yes, they are married. She just took off with her mother with the kids while telling my son she was on her way home and now won't even answer his phone calls

    A:He can file in Court for custody or visitation./And for divorce./

    Another question here can be s.c. KIDNAPPING, but it is a very hard court battle.

    I'd be in Family Court, filing for custody and the return of the children, when the Court doors open on Tuesday (Monday being a holiday).

    He would have to file for divorce and custody because yes she has the right to do this. They are her kids as much as his kids. I won't guarantee that the judge will return them however because they are married therefore equal rights to the kids. If they were divorced and there was a visitation order in place it would be a different storty. What state is he in?

    As noted she can do this. However he can fight it. He needs to get a lawyer and file for divorce and custody. There is a good chance he will get some sort of visitation.

    Yes, this is a very bad thing, and it can hurt. It is not kidnapping since it is her kids also. Alll he can do is file for divorce, and custody of the children. Sadly this is for to common
