What can I do if I do have a lawsuit over an old debt
I just recently found out about the statute of limitations on credit cards. And also found out if I got hit with a lawsuit over a debt you must show up,or I would be hit with a default judgment. Well I have a credit card debt that was in 2000-2001 and I did get hit with the lawsuit in 2006 and didn't go to court.Cause I didn't know my rights.I want to know what I can do about it or if they can still make me pay that debt. Its been well over 7-8 years now and I'm getting calles from them threating me to garnish my wages. Is that true? Can they garnish my wages?Ive been told so many things about my credit. I want to know most my debts are in the past and they can't be cleared up I don't want to file bankrupsty but with the scary phone calls on garnishing my wages it makes me want to file bankrupsty. Thanks Crissy

Yes, if they have a Judgment they can file a garnishment against your wages.

I think it's too late to get this set aside - the Statute does depend on the State. Could have been 4 years, could have been 7. What State?

Only you know if you qualify to file in bankruptcy or if it makes sense. Sometimes the legal fees, filing fees, blot on your credit are worse than the Judgment.

Wow. Good thing in the Philippines they can not garnish your wages. If you gotsued and the credit card company win, what they can do is only try to get things under your name like cars or something. Again it must be on your name otherwise they can not touch it. Your house is also out of the question.
