Breaking a Lease in Texas.
I have lived in this apt for almost a month. I currently had sum harassment from a crazy old friend. She and her criminal boyfriend have threatened to hurt me and my three yr old son. I moved all my stuff out and I am hoping I get out the lease w the police report filed and statements from nieghbors that saw them harass and threaten me. I took her stuff out my apt since she is not on the lease and was just crashing there because of her breakup and had no where to go. She out wore her welcome and when I asked her to leave her dumb boyfriend had her house key I let her borrow and locked me out my own place. I called the cops they came. Which was no help... and he atacked me as well as her. I fear for the safety and well being of my son. Will this be enough to get out my lease...

Breaking a lease in TX
I have been harassed and threatened my a friend I let crash in my apt. She was suppose to say for just month bu, her boyfriend started coming around and I advised her that I was not OK with that so she had to leave. She out wore her welcome in my HOME... then she gave tha house key to her crinimal boyfriend that locked me out of my own place!! I called the police s=took her stuff out and he got arrested. The girl came and got her stuff but kept threatening me. My apts are income based and I have been there since July 25. I fear for my safety because of the events of today. Will this be enough to get out my lease.

Hi, lovebird20!
Greetings and WELCOME to the site! I just moved your question that you had posted in Introductions to this topic area so that it would get the most exposure to those who are best able to answer it. Introductions is for people to introduce themselves and we try to not ask questions there.
I'm also going to request that your question about the same situation that you posted over in Small Claims be merged with your question that I just moved from Introductions.
You have a complicated situation involving a number of issues, and I do feel for you in what you are going through! But, your one main issue that you are asking about because of how you have titled your questions would be about breaking a lease in Texas. As such, I'm sure that your question will get much more exposure and attended to by the best experts able to answer it in this topic area.
I wish you and your son well and hope that things will work out the best for the both of you!
Thanks!

Lovebird, just from what you posted I don't see a legal reason to break your lease. In Texas, the only reason a landlord has to let you break your lease is the Military exemption, unless your lease states otherwise. That's not to say that your landlord won't be understanding and try to help you out. Even if they do help you out, don't expect to get off scott-free. I would expect there to be some penalties or costs associated with getting out of it.
Have you spoken to your landlord about this yet? I would recommend meeting with them ASAP and take in police reports/ whatever you have. Do they have other properties you might be able to transfer to?

None of your problems are the fault of the landlord so why should the landlord suffer? You made your bed, now you have to lie in it.
I don't quite understand why the police were no help here since you say he got arrested. What you need to do is get a restraining order against them. But you have absolutely no gorunds to break your lease.
