    Breach of Lease due to parking
    When I moved into my apartment at the beginning of the summer the apartment community was only 53% full. I did notice that the community did not have very many uncovered parking spots, but since it wasn't at capacity I did not mind. My roommate and I were assigned one parking spot for the both of us, which is understandable I guess but a little questionable. But since I live by a college university and the new semester is about to start the community is up to 98% occupancy. It has now been 13 days of coming home around midnight and not being able to find a parking spot due to the complex being almost full and are lacking parking spots. With the lack of parking spots I have been forced to either park off-complex or in other peoples covered spots. The last time I parked in another resident's parking spot I woke up the next morning and my car was towed, and I was charged over $150 to get it out. What I am trying to ask is it a breach of apartment lease if the community does not have enough parking spots for its residents?

    No. It would be a breach if they say you had two, but only gave you one. But you signed the lease knowing that one of you was going to be finding creative parking spots. This is common at many complexes, since many of them were built at a time of single-car families, and haven't kept up with the new way of having 2-4 cars per family. You may want to see if there is a garage in the vicinity where you can lease a spot for the remainder of your lease.

    I agree with Froggy. They're not breaching anything - especially since they told you up front that you get ONE spot.

    I read this and had to shake my head. Where the heck do you get this stuff? But what stretch of the imagination could you think that not providing enough parking would mean a breach of the lease? You were assigned ONE space. That should have told you you might have a problem parking. And what could possibly justify you in thinking you could use someone else's spot? I'm not surprised you were towed.

    You sound like a spoiled brat and you really need to wake and see what the real world is like.
