A former employer gave a reference on me to a potential employer. The former employer told the potential employer that I was on medication. I have never signed any medical release form nor did I have medical insurance with the former employer. I was with this company for a few years before I turned in my notice. They also gave me a bad reference. They made out like I was crazy. One more thing I'm not even on medication and have not been for over a year. What should I do. :confused:

All you can do is go to the place where you applied for the job and tell them your side
And maybe don't put the old employer on your applications or else make a notation that they are being hostile toward you and making up lies so you prefer them not contacting them.

Did they lie on your reference - was there a reason for the bad recommendation - and did your medication play a part in that bad review - ?

I think a bad reference is unusual because most employers, out of fear of being sued, tend to give a good or bad reference with no details or simply confirm the dates of employment.

Yes They did lie. I use to be on anti depressants. They made like I was on crazy medication. There was no reason for the bad reference, other than me leaving the company, but I did apply with another company that did the same type of work and won against them on a non-compete agreement. That was brought to me to sign two years after I was hired, and not only I but others were told if we did not sign it. We would be fired.

If you can prove they gave you an undeserved "bad" recommendation then by all means I would contact an Attorney and sue for all of your damages - loss of employment, loss of status in the community, whatever your damages may be.

You have a heavy burden of proof - what was said and how you were damaged - but it is possible to win these cases if the recommendation was given out of malice or revenge.

But this is nothing to attempt by yourself.
