    1040 ez or 1040nrez
    Thanks for the update.

    Iam from India. When I filed for 2003 and 2004 in Turbotax I got my tax returns and everything went fine.
    So is everything fine as I am from INDIA.

    Now to correct that mistake what I have to do?

    Now for 2005 tax filing , I am on F1 for for first 4 months , then I worked in Newyork for 2 months, then I moved to Florida for the rest of year and still I am here.I was In OPT period for all those work periods.

    What are the list of forums I need to fill for 2005 taxes and what is th last date to correct my mistakes for 2003 and 2004 tax filing ad can you please tell me the list of forms I need to fill and when I call fill those.Is there any particular deadline for it?

    I appreciate your help.

    Dear Experts,

    I have filed my 2003 and 2004 tax forms on turbotax on F1 visa status.
    I filled 1040 EZ forms at that time as I entered my SSN into it, those were the forms I got.I did not claim any social security tax or medicare taxes for both years as that was not listed on my w2 forms and I did not claim any of it. I just claimed my Federal and state tax for both that years. Did I make any mistake.

    Now for 2005 filing I am on f1 for first 4 months then I am on my OPT for the rest period.I worked in two states in that period they are newyork and Florida.

    Florida does not have state tax.
    Can you please tell the forms as soon as possible so that I can fill them online in turbo tax ot taxact.com sites.

    I really appreciate your help.

    You filed Form 1040EZ incorrectl for 2003 and 2004. You should have filed Form 1040NR-EZ.

    If you are from India, there will be no additional tax because Indian students can claim the standard deduction, so amending the return is not really necessary. If you are NOT from India, however, you probably need to crrect this problem.

    You will need to file as a resident alien in 2005 (Form 1040EZ), plus Form IT-203 for New York as a part-year resident.

    Technically you should file Form 1040X to submit Form 1040NR-EZ to correct the error of filing as a resident alien instead of non-resident alien (the correct filing status). However, no additional tax will be due, so if you do not amend the returns, it is likely no one will notice.

    For 2005, you can probably file Form 1040EZ. For NY, you will need to file at least Form IT-203 and probably a bunch of support forms. Recommend you use www.taxact.com to file both the federal and NY state tax returns. If you OWE money to either the IRS or NY, you need to get it done by midnight on Monday, 17 April 2006. If you are due a refund, do not worry about the deadline, as there are no penalties for filing late if you owe no taxes.
