    Length of probate in Nevada
    Help!
    My brother passed away Jan 05, At the time of his death we thought we had all the loose ends tied up and his living will would take effect upon his death. He was selling some land at the time(40 acres,$ 80,000) and we were under the understanding by his agent every thing was a done deal, then he died, and yep the land sale fell through. Since the land wasn't in the will we were forced to probate the will. Now 3 1/2 years later we are still waiting for the final outcome. There is nothing being contested in the will. The attorney handling the probate (when he returns his phone calls, but that's another issue) says that's just the way it is and it takes this long. This is in a small town in NV , I live 2000 miles away. We talked to the other attorney in town and he is to busy. I don't believe I can sell the land until it goes through probate.
    My question is HOW CAN I LIGHT A FIRE UNDER THIS GUY TO DO SOMETHING! Do I just fire him and start over? My brothers heirs are coming of age in which I can start to distribute some funds but I want to have everything cleared up and know exactly how much money is involved before I will start to distribute it.

    You can contact a local judge in that county or a circuit judge for the district. Ask them how long its suppose to take. Ive never heard of it taking years to process. Since there is a will then that portion shouldn't have to be probated. The instructions are already there. Are they tryng to sell the land so they may get a commission and then distribute the funds ?

    No I just wanted everything cleared up so that I would know the money I would be dealing with for the heirs. Plus this part of NV follows the gold markets, several mines in the area,thus values in the area are up. But being in probate I can't sell the land and have not been able to for 3 1/2 years. I have had several offers but am not able to sell. If gold falls the land will lose value. I want to sell it on my terms and time frame to get best price for the estate.
    And I guess I'm just pissed that I'm getting the run around by this guy. His last statement to me was he would try to get around to it maybe in Sept but most likely it would be sometime in Nov as he would be going on Vacation. I am telling you the truth after over 3 1/2 years he might be able to get to it sometime in Sept. but most likely not. By the time this is done it will be over 4 years for a simple probate! I have tried to be patient, but after over six non returned calls the past couple of weeks to his office and then for him to give me this kind of answer just fired my rocket and I've had enough..

    Should have been cleared up long ago, sounds like time to fire that attorney and hire a new one
