    Unborn Child Custody
    My ex-girlfriend is 1 1/2 months pregnant and is in the process of leaving the country for good. Can I obtain custody of my unborn child before she leaves? If so, how do I go about doing it?

    You would have to wait until the baby is born and prove you are the father through a paternity test before you could do anything. Then you would have to file for full or joint custody but if she is not an unfit mother and she is out of the country it doesn't look like there is much you can do without her consent.

    There are all sorts of issues surrounding this, after all she is only 6 weeks into her pregnancy.

    What makes you think that you would get custody over her, when the child isn't even born.

    One of the major issues in awarding custody, is to prove her to be an unfit mother, which in this case does not apply.

    I would advise you to seek out a solicitor, who can give you the correct legal advice.
