    File as Resident as well as use treaty?
    Atlanta Tax Expert,

    I will choose to file jointly with my wife as US residents, so we are supposed to take Standard Deduction of $10,000.

    Besides, can I take another $5000 exemption under US/China Treaty since I'm eligible for that?

    In my opinion, no, you cannot.

    However, there have been several posters who feel that you can take the treaty exemption one last time in the year you file as a resident alien. I do not agree, but I thought you should know.
