    Father incapacitated, in home, in debt
    My father recently was rendered mentally incapacitated and placed in a nursing home. He is unable to manage his own affairs and I have power of attorney. He was living on fixed income, social security. This money is now being paid to the nursing home with nothing left over for his prior bills.

    He left no will or plans for his affairs. My parents were divorced 3-4 years prior to this happening. I am left with an upside down travel trailer (owing approx $12000), a credit card with approx $3000, and various utility, phone, etc, bills.

    I know I'm not liable for the debts but should I declare bankruptcy for my father? How do I handle the collection agencies and other creditors? I am considering letting the finance company repossess the trailer but my mom's name was never taken off the financing so I'm concerned on how that may effect her as well.

    Even if your father declares bankruptcy, your mother is still liable for the trailer. Unless you can legally get her name off it she's going to owe the balance.

    As for the rest of his debts, let the creditors sue. Your father is judgement proof.
