    Non paying relative
    Hello.
    My mother has let one of her grandsons stay in the building over the garage on and off for the past 5 years. She is 78 years old and has grown tired of his continual bumming off her. She has asked him several times to leave and given him 30 days to move out. He has not done so, and has even now brought a woman in to stay with him. There is no running water or bathroom in the building, so my mother has allowed him to use her bathroom and kitchen to cook food. She has not charged rent because of her medicare situation. This situation does not fit the "eviction for not paying rent scenario", and we are somewhat at a loss as how to get him out. My mother lives in NC.

    Does anyone know how we can get him out or do we have to use a sheriff or a lawyer?

    He is very manipulitive and knows how to work on my mother's sympathies. He is in his 30's, never worked more than 3 weeks at a time on any job, has some kind of mental problem. My mother is also afraid of retaliation even if she does get him out eventually. He has in the past beat up his own mother (his mother does not know how to cope with her own son, and lets him bum off her own mother, so she does not have to deal with him), sister, and brother when he was drunk. We, the other children, have gone along with our mother's wishes in the past, because she kept saying he needed a place to live, but she is finally seeing the her grandson is not going to take responsibility for his own life and will use her up like he does anyone he comes in contact with.

    If anyone has any advice, I would appreciate it. Thank you.

    Technically he is living in a garage with no bathroom or cooking facilities. What you could do is check with the local building and zoning people and ask them about this arrangement if it is legal or not. If it is not legal, then the building dept will send out some sort of violation for having humans inhabit an uninhabitable place and make the grandson and his girlfriend move out. This way the grandma is not the one who is to "blame" for him having to move out and move on. If he has some sort of mental problem, this scenerio would seem best as then he won't think grandma made him move but the County made him move and leave grandma alone. She should under NO circumstances let him stay in her home after he is removed from the garage loft. The price of the violation fine hopefully will be much less than an attorney and court costs would be to remove him.
