Settling an Auto Accident Claim
I live in Oregon, my total dr. bills are approximately $9,000. The damage to my car was approximately $4,000. How do I figure the diminished value on my car? How do I estimate a value on time and activities that I was unable to participate in with my family, like water skiing, snow skiing, etc. How many years should I estimate possible doctor visits for? How much is mileage reimbursement? How do I figure my loss of personal time with my spouse?

That's what lawyers are for, and it's best to hire one. I don't know what the laws are in Oregon, or whether you can get compensation for not being able to water ski or snow ski, or for loss of personal time with your spouse, but pain and suffering, loss of wages, doctors bills and car damage, those are all legitimate claims. Get a lawyer, it's worth it.

Loss of value on the car, one way is to take it to several lots and get a written appraisal showing what the extra value is if it was not for the accident, depending on bent frame or other damage, some damage has little real effect on resale. I would guess about 10 to 20 percent of the repair bill.
Settle on doctor, I would not settle unless I was well, I would make them pay for the car right now and pay all current doctors but if you have years of doctors you want the case open and them paying. But your doctor should give you a idea of how long you will need care. Also if there is any percent of disability Missing family outings, really no value Loss of personal time, really no loss of value Those fall into that "pain and suffering" rough value I often see, a sum equal to your doctors bills. |
