    Terminology for terminating real estate contract with my realtor
    When signing our brokers contract to list our house, she put in a clause that stated that we could cancel the contract for any reason whatsoever. Now I would like to cancel the contract, although the contract should still run for another 2 months. I am concerned that if we should find a buyer in the very near future that was not due to her advertising but instead to ours, how will we be sure that she will not demand commission? When we sit down with her and sign that the contract is now no longer valid, does anyone know what terms we should state in it that will release us of her commission, should we sell it ourselves before her contract is set to expire? I hope someone can give me some advice. Although she did add an addendum that we could cancel the contract for any reason, does that automatically imply that if we sell it after we have prematurely terminated it, she is still exempt from commission. Thanks so much for any advice.

    It's implied, but to be safe you should include some language in your termination notice. Just say something like "Pursuant to the addendum to our agreement, we hereby terminate this agreement as of July ___, 2008. You will continue to be entitled to a commission if our property is sold to someone you introduced to the property within ____ months from this date, as per the contract. However, you will no longer be entitled to any commission if the property is sold to someone you did not introduce."
