    Repossession Law in NYS
    I financed a car in GA and moved to NY, I have not made a payment to the finance company in over a year due to financial hardships. I've recently started receiving calls from the finance company regarding the car which is still in my possession. They sent a tow truck to my employment but still have not found my car. The finance company and the repo man says that if I don't give back the car they will report the car stolen. Can they do this?

    Not really but they can sue you, get a judgement for all of the costs of the car, for the legal fees and garnish your wages, attach your bank accounts and things like that. Also they can stop you from registering the car and getting any current tags, And they can also report this failure to your insurance company and perhaps get it cancelled.

    You have not paid for it, you need to let them have it, anything else is just morally wrong, and it can cost you a lot more in court when you continue to hide it.

    You haven't made a car payment in year and it's taken them this long to find you? Amazing.

    They could report it stolen but I don't think the charge would stick; in fact, the Police may not even take it UNLESS there is something in your finance company contract which does not allow you to take the car out of State and I have seen that in a contract only once, but I have seen it.
