    Old credit card debt questions
    Hello just wanted some advice and input on the following issue,

    After about ten years of hearing nothing about this old credit card debut,
    I have been getting phone messages for the past 6-8 weeks from some legal company saying they represent this other company that has bought this old credit card debut. This credit card they are talking about expired in 1993 and the last min. payment was made some time before 1997.
    This credit card was used in the Province of New Brunswick and I now live in the province the ontario(6yrs) both of which are part of Canada. I have not talked to them and keep deleting the messages from the phone as I am scared of saying something wrong to them and getting into some law issues about restarting the Statue of Limitations.

    Can they sue me?
    What is the length of the SOL for these Provinces?
    Should I talk to them if they call again?
    If so what should I say?

    I went through hell for about 5 yrs in the 90's with these type of people and I really don't want to start worrying about this all over again.

    If they call back, tell them to put it in writing, AND THAT ALL CONTACT WITH YOU TO BE DONE IN WRITING.

    Just another thought, if or when they put it in writing then what? Do I just ignore them?

    If and when they put it in writing, don't agree to anything they ask, SOL is passed. THey will tried to get to you re-affirm the contract. Don't do it.. Tell them to proof their claim, if possible. Your reply is "Timely refused for cause, without liability or recourse to me." In red ink. Do not wish to contract with you. And mailed it back. Your must respond to any presentation. Make them prove their claim.

    You say that last min payment that was made, was made sometime before 1997. So let's just assume July 1996. Therefore, it has been approximately 10 years.

    Ontario's SOL was 6 years back in 1996….but its New Brunswick's SOL that is relevant in this case.

    I have been New Brunswick's Limitations act, Nov 2003, and it talks about SOL's being 2 and 6 yrs on various types of law suits.

    Although that is not quite helpful as you need 1996 numbers, not 2003 numbers.

    I can not seem to find 1996 numbers. I'd be willing to bet its 6 years, but I don't know that for sure.

    Either way, as Mr. Yet said, don't communicate by phone, just writing. In fact, I would ignore all their calls/letters.

    Just want to make sure I haven't missed anything.

    How can I find out if any judgments are against me?
    If a judgment exists is there a sol on it also?

    I was given a Notice of Right to have Exemptions Designated for an Visa card that was opened in 1995, when I called the lawyers about this they told that the court would sale my stuff How do they get to come and just take my stuff?
