I have recently gotten married, and my husband is currently in the US Army. I was not married to my daughters father. He has visitation rights Not by the courts, we agreed on it and I have custodial custody of my two year old daughter, and when my husband gets stationed we want to go with him. Am I aloud to move if we make another visitation agrrement? And how does out of state visititaion work??

First you said you do not have a court visitation?? Is he on the birth certificate, is there any actual custody agreement from the courts ?

If there is a legal agreement what does it say about you moving out of state, if it says you have to get the babies fathers permission to move then you will have to get his permission to move.
Many custody agreements require permission of the other parent before you can move. To ensure his visit rights are protected.

If you have no formal custody agreement, then you can just go and he will have to sue in court for his visit rights. He may get joint custody where he gets the child 1/2 the time, or he may get extended months over the summer after they are in school, It just depends on what he asks for and what the courts give him.

No there is not court order visitation. And in the agreement it said nothing about moving out of states

No NOT through the courts we both signed and agreed on it and then I filed it in the court system.

If there is nothing in any agreement, you are free to do as you wish, but to be honest, you should have a formal agreement, with child support ordered though the court

You we have court ordered child support. We just did the visitation and custody on our own and didn't even want her until I took him to court for child support. I am currently doing a modification to visitation, I got the paper work this time through the state and I have someone I know who works for the state helpe me with everything like last time so I do all the correct paper work.
