    Attaching a lien
    I sold a business to a guy a while back, and he or I was supposed to put a lien on his house until the money for the business was all paid. It was never done. Now things have gone sour, so my question is:
    Can I attach his house now?
    What is the proper procedure?
    Can I go to the city hall and do it myself?

    Welcome to AMHD. Just curious: was an attorney involved in the sale? Did the purchaser sign a promissory note? When did this transaction take place?

    The sale took place Sept. 2000, New Hampshire, he/she signed a contract to purchase paper, No atty

    Hello S:

    If the agreement says that he agreed to a lien, then I suppose you could do it now. If it doesn't, then you'll have to sue him and hope for the best.

    The purchaser signed a contract, but we have not way of knowing the terms of sale; it the deal has gone sour, as excon has said, "...sue him and hope for the best." If you are successful, have the judgement recorded, which will constitute a lien against all his property. You will do well to get an attorney if you are out a lot of money.
