    NY felony probation
    Is it possible for me to be released from Felony probation in NY State after my fines are paid? Probation is affecting my work. My boss is getting very upset with me having to be late dor work every month, and frankly I'm tired of losing the hours every month. What can I do if anything??

    Hello player:

    Ask your po for the procedures and policy manual for his department. In it, you should find a paragraph or chapter on early release. If you do, it will list the criteria. Meet the criteria, make a written request citing the rule, the criteria, and that you meet them.

    If you DON'T find anything, then file a motion for early release in the court that convicted you.

    In addition to what was stated above, I hope you understand that the judge who ordered the probation is the final authority in the matter. I was a probation officer in MD for 7 years and saw many cases where the conditions of the probation caused serious problems for the person attempting to fulfill the conditions while attempting to maintain a somewhat normal life. Not many of these people were able to convince the judge to reduce the expiration date.

    When the court case was over and the judge decided on the conditions of probation, including the expiration date, he did so based upon representations made by people such as the prosecutor, the defense attorney, a records check, the nature of the offense, etc.

    In order for him to reduce the probation expiration date, you must demonstrate to the judge legitimate reasons as to why this is necessary. Of course you must be in full compliance with the existing conditions.

    Unless specified in the probation order, the probation officer cannot change the expiration date without authority from the judge. I have seen probation terminated early in cases when the person wanted to enter the military, and a few hadship cases, such as the need to care for an elderly parent. But in my state such reductions were few and far between.
