    Lease/foreclosure
    A Month After We Signed A Lease For This Home,we Received In The Mail Docs Stating That The Unknown Tenants(me) Of Said Property Were Defendants In A Suit Filed To Foreclose On Said Property. I Answered The Courts Stating My Name And That I Was The Unknown Tenant. This Info Is Now On Record At The Courts. Now That I Am The Lis Tenant,how Does This Foreclosure Acton Effect Me? I Feel That The Lease Has Been Made Null An Void, Because Now I Can Not Live At Peace Or To The End Of Our Agreement. We Have Now Found Out Htrough The Court Records He Has Not Made A House Payment In 10 Months. I Would Think There Would Have To Be Some Violation Of Truth In Renting Somewhere. The $3000.00 I Gave To Move In Also Was Not Placed Toward The Mortgage.

    Yes you would think it should be, but its not, he still legally owned the property and had a legal right to lease it to you. And you are still bound by that lease till the actual foreclosure happens. Once the house formally forecloses, that does end the lease.

    Now of course the same bad news, legally they are suppose to put that 3000 in the bank and hold it as a deposit for you. But if they have already spent it for something else, odds are you will never see that money back either.

    So it is time to sit down with the owner and see if some exit terms can be worked out.
