    First time voilation on felony probation
    :confused: Ok I am newly on Felony probation and I was hanging out with a well what I thought was a friend who stole a purse so threw away all the lady belongings and I had her creidt card and used it to buy gas 23.00 dollars worth but because the girl didn't step forward and tell she took the purse I got charged with a POS how much time am I looking at even with me willing to pay all and any money to replace the damage

    I think that is all in the judge's hands. The could be more lienant since it's a first offense and you show true remorse, and have learned from the experience.

    I don't think paying it all back is what they want, they want you to learn your lesson, that's what jail, prison and probation are for.

    Whatever you do, don't take any new conviction because they will violate you. I would try to fight that charge if I were you. I caught a new charge while I was on felony probation and my PO said she can't violate me until I'm adjudicated guilty.

    This all depends on what the original sentence was for your felony and how long you were to be on probation. If you are convicted of the new charge you need to read your original sentence paperwork. It will spell out quite clearly just how many months you will have to serve in jail if you violate your probation.

    You do realize that using the stolen credit card is a criminal act in itself, separate from stealing the purse? So even if the friend had come forward and said that she stole the purse, you still can be charged. So, I wouldn't be using that as a defense when I go to court if I were you.
