Can my Room mate's boyfriend live in our shared apartment without paying?
I currently live in a two bedroom apartment in Ontario with my boyfriend (who pays rent and is on the lease) and my previous room mate of last year (who pays rent and is on the lease). However, my previous room mate has a boyfriend who has consistently been in our apartment (approx. 6 days a week he is here). Yes I agree that we all have the right to be with the person we love, but he is here using cable (which he pays for), the internet (that he doesn't pay for), and the whole square footage of our apartment (which he doesn't pay for), minus my room. Our rent includes utilities as well, which he uses. My room mate argues that she pays for her rent so therefore she is allowed to have him here when ever she likes, which includes the time that I am at work and she is at work, so he is basically hanging around our home when no one is here. She argues that I'm being greedy and I'm after money. I argue that he has been here consistently since January 1st 2008 and it is now May 21st 2008, he begins work June 2nd 2008, but that won't stop him from being here after work and during the weekend. She also argued that he doesn't have enough money to travel between his home that is half an hour away from our home and also that he requires a place to stay to make it to his new job that starts in June. In January we discussed that he doesn't have to pay rent if he wouldn't be here a majority of the time but that obviously never happened. Neither of them follow through with what they agree to. I argue that each individual has to pay for square footage used and utilities used. I just want a reprieve from him being around, or I want to be compensated for the amount I and my boyfriend pay for him being at our home constantly. I want to know where I can draw the line? What can I do? Are there any legalities that I don't know about?

Good argument, but a question, what does the lease say about guests, does it limit a guest to a certain number of days per month or per week?
Many do. What requirements does the landlord require if there is another person living in the apartment.

In general people are allowed guests in their apartment, so you will have to fall back to the legal agreement you have with the landlord.

I've read the basic rental agreement but it doesn't state anything about guests, but I could speak with management about it. I know that he parks in the guest parking spot without paying the 5 dollar parking payment ever. It is a nightly payment but he never pays it.

Unless the lease limits guests, there is proably very little you can do about this. You can try to restrict his use of common facilities. You can show that his staying there has caused an increase in Utilities (heat/electric) that needs to be compensated for. But she is entitled to have guests.

Comments on this postamcasbur agrees: Thank you for your help. But I have found a resolution on my lease agreement and I have spoken with management and they have told me I'm within my legal writes to either demand he leave or pay his share.

What does your lease agreement say? What clause are you basing this on? I would not trust the management company to give you legal advice.

You certainly can demand that he pay his share or leave, the question is whether you can enforce it and how you determine what his share is.

Right, the management company has no interest in this and most definitely should not be giving any advice, let alone legal advice, other than... "It's not our problem." Rely on them and this could blow up in your face - you have no grounds that I can see to demand that anyone do anything and even if you do, you have no follow up if they disregard your "demand."
