    Probation violation
    I'm in Georgia and my fiancée got charged with probation violation and sentenced to 15 years but this was a plea and the terms are concurrent. What is the minimum and maximum time he has to do before being able to get out for parole? The judge sentenced him to this. Also how fast could we get married if we wanted to while he was in there. He hasn't left yet but do they count the time that he is in jail plus when he gets to prison? Is the time down there two for one like up here.

    If he violated he "probably" will have to serve his full prison term plus whatever is ordered concerning the violation.

    Not a legal answer, but why do you want to marry someone facing 15 years in prison? I understand why he would want to get married but I don't understand why you would.

    I don't know what you mean by "two for one like up here." Did someone tell you that 1 day in jail in Georgia counts as 2 days in jail somewhere else?

    Some prisons/jails allow marriages, others do not. Call and ask.

    He will be sentened to the full orgainal sentence in GA.
    If this was a non violent crime, his first parole hearing will be after he serve 1/3 of his sentence, so if he has a 15 year sentence, most likely his first parole time will be in that 4 to 5 years. And a lot of this will depend on if the victims have any statements read at the hearing, if the original DA appears and protests ( they can do that) also since he violated his probation to the point of being sent to prision it is very, very likely his first time at a parole hearing will be turned down since they will look at the fact he had a chance and messed up. So it is very likely that he will not actually get parole till 1/2 of his sentence is served. And this is also assuming he does not get written up in prison very often, if he does not get invovled in the drugs, or esp fights and things like tattoo guns and other things like gamblimg. A lot of write ups ( DR's) in the GA prisons can hurt their parole hearings.

    Now for what little good news, GA prisons are over crowded, he may have to wait months in county jail till a bed comes open. So if his original crime was a non violent crime, no armed crime, no assault crime then they may let him out at first parole hearing since they are over crowded.

    Also once he is in the state computer system, you can enter his name off the Dept of Correctons web site, it will show where he is at, his photo and also show all of his crimes he was put in prison for but it will show the first date he will be considered for release.

    In Georgai, they do not allow "sexual" vistis, so there is no way to validate the marriage in GA, Also when he firsts goes in, he will be most likely either at Doge or Jackson for the first few months, these are intake prisons where he will be evaluated, given phsycials, and his security level will be set. So depending on his security level he will go to one of the many prisions in the state. Then as he does time, if he stays out of trouble, his security level can go down, and he can be transferred to other prisons that offer better living conditions for the inmate.
