    Landlord ordered to pay.
    $2,000. She claims she can only afford $75/month. She paid for 3 months and we haven't received this month's check. I will give her till monday. If she in fact hasn't sent out that check, what actions can/should we take?:eek:

    I can't tell you what to do as a landlord, but I will tell you the two things my co worker said I'll ever need to know. 1) I won't in your mouth. Doesn't matter what you do after that, just say it. 2) The check is in the mail. Keep saying it and the person will believe you even after saying it multiple weeks. "Oh, turns out I didnt send it because I found it last night...check's in the mail."
    If she doesn't pay then evict her. She has friends, everyone does. And if she did send the check then you didn't cash it and she still has the money for something useful. Don't always be kind. You have rules set in place to receive rent. Someone doesn't pay, get rid of them. If you're wrong, then apologize and they'll say how much of a jerk you are to their friends, big whoop. If she's screwing you over then she'll be angry, but she would have earned it.

    If they were ordered to pay by the court, then do you have a judgement ?

    If you know her bank account ( if you wrote her checks, her accouint may be stamped on the back of your check) you can see about garnishment of her bank account.

    k, that's what i thought but i wasn't sure, i'm pretty sure i have an old check hanging around with her account on it. What is the process? Do i have to go BACK to the court? Lord knows i know that place inside out and i'm sick and tired of having to go there. It really amazes me that people think they can just do as they please. Oh and yes, there was a judgement.

    You have to file a motion to garnish ( assuming you are allowed to do so in your state)
