    Does a non-biological father have rights?
    My daughter is now 7yrs old and she has never seen her biological father. I've been married for 4yrs now and my husband has been raising my daughter since she was 2yrs old. She really only knows him as her father, she calls him dad. She has a 3yr old sister from this marriage, basically we're a happy family. Now after 7 yrs her biological father filled for visitation. My concern is that my daughter has never seen this man he's a stranger to her. Does my husband have any right to my daughter? What can we do?

    He has the rights of a stepfather. Has the bio father been paying support?

    I have been receiving $28.00 a month (court ordered) from the bio father that started when she was 4yrs old.

    If you have a follow-up post, don't edit a previous post, just add a reply or answer to the thread, I edited your posts to show the answer as a follow-up.

    If he's paying support, you might get him to agree to let your husband adopt since that would cease his support obligation.

    The bio father will have rights, and the court may ( or may not) reconise them, unless he is willing to give up his rights to allow your husband to adopt, the step father has no rights what so ever at this point.

    So if he wants to visit, most likely the judge will allow it, perhaps supervised to start since he does not know the child.
