    Not Sure why NJ State Taxes Withheld - What to do?
    Hi,

    I'm a student living in State X. My summer internship was in State Y. When I received my W2, I realized my employer had withheld taxes for States X, Y, and also for NJ.

    I am not a resident of nor did I do any work in NJ this fiscal year. The only connection I have to NJ is that my parents live there but I have NOT been a dependent of theirs for years. I am registered to vote, registered my car, and have a drivers license in State X and have been a resident of State X for 2 years now (in fact, I get in-state tuition in State X because I'm considered a resident).

    I'm pretty sure my employer messed up my withholding by assuming that some old mailing address somehow reflected a state of residency. I know I did not enter NJ as a my resident state on any tax or employment form.

    Can someone please help clarify what I need to do? I don't see any forms on the NJ DOR website related to recovering the amount (that seems to have been wrongly) withheld by for NJ state purposes.

    You basically have to file a return for nj, showing no income attributable to nj but tax paid.. bottom line is requesting a reund from tax paid in error. Might want to attach a letter of explamation

    You will hve to file a tax return for nj showing no nexus or any other nj ties. Attach letter to retun stating reasons you are seeking refiund of taxes paid,

    You worked in Y state so you file tax return for Y state. Report only the income when you were in the Y state.

    You live in X state so you file tax return of X state. Report all the 2007 income. Also claim credit for taxes paid to Y state.

    Your employer withheld taxes for NJ state so you file NJ tax return also. You wll show no NJ income and nonresident. Attach a letter from employer that you do not live in Nj and never worked in NJ.
    Ask your employer to stop withholding taxes for NJ.
