    Collection of credit card debt if insolvent and on disability
    My sister is 50 years old, lives in Florida, is totally disabled and receives social security disability. She is receiving threatening calls from a credit company who states that they are going to garnish her social security check (I think she gets ($800/month) and have told her that if she doesn't pay her parents (80 year old) are liable. The creditors keep asking for her bank account # and I have been explicit with her as to NOT give them that number.

    She lost her business over 4 years ago and was operating at a lost. At that time her husband left her, divorced her and filed bankruptcy without her knowing it and listed her and our parents as creditors (nice guy). Well all the creditors are coming after her. She is very ill. She does not own anything.


    What can she expect?

    He social security can not be garnished, and they can not make her parents pay unlless they signed on the cards.

    This may be hard to believe but they will lie if they think it will get them their money, most likely they will say the police will come, maybe they will tell her they will come after her car tomorrow, they will say they will put her in jail, they will tell her anything they can, if they think it can make her pay.

    She needs to write them and tell them not to contract her by phone any longer.

    But then she needs also to stop using any credit cards if she still has them, cut them up. Also don't give any bank account info to them ever.
    If she actually pays them do it by money order.

    But she may want to also consider filing bankruptcy to end the debts also
