    Foreign Income without W2
    Hi,

    What can we do if we don't have W2 about the foreign income. We do have an other form from Holland in Dutch. Is that OK to send?
    Tried to call IRS but there is no one who can answer for alien's questions.

    Other question is: According to publication 519, figure 1-A, we are treated as resident because we have met the phisically present test during 2007. Do we have to send any statement? If I understand it well, that doesn't mean first- year choice, though we have to pay tax after worldwide income.

    You report this income on the same line where you report W2 income. Then you will do Form 2555 or Form 1116 to claim credit for the taxes paid in the foreign country.

    About second part of your question: What visa do you have? When did you enter the U.S. Are you married?

    We have L1 and L2 visa, married. We moved to the US in 03/16/2007. That means 290 days in 2007.

    You became resident in 2007, it makes you Dual status for 2007-- nonresident in the beginning of the year and resident at the end of the year.
    You can file resident return for full year only because you are married and you are allowed under First Year Choice. Normally you enclose the statement: We... and... qualify to file as residents for 2007 and make as choice of being treated as residents for tax purpose for the full year 2007.
