    Request for admission
    How long does the other side have to respond to a rquest for admissions? If they do not in a timely matter what do I do next?

    Hello p:

    You're dealing with small claims court here. Of course, the other side isn't going to act like a lawyer. You don't need to either.

    Just go to court with what you've got. Tell your story, and if there are answers to questions the judge needs, the judge will ask.

    Given that you posted this in the Small claims forum I would assume you are referring to a request for some disclosures on the part of the other party.

    It would help if you gave more details, but since this is small claims court, they do not have to respond. Small claims is more informal. Has a hearing date been setup yet? If so, they have until the hearing to respond. If not, I would have specified a response date in the request. If they haven't responded within 2 weeks I would do one of the following; either send a follow-up request giving them a date by which they need to respond or request the court to schedule a hearing and bring up their failure to respond at the hearing.

    Note: that they may not be required to respond. The 5th amendment gives us the right not to self incriminate. So they do not have to answer any questions that help your case.
