    Eligible for Foreign Income Exclusion?
    Hey,

    I currently have an E2 Visa and I come from Germany. I came to the US on 06/28/07 and I went back over Christmas from 12/24 (=less than 183 days). That would make me a non-resident alien, correct? I was still employed in the US over Christmas and got paid in the US (Holiday and Vacation Pay). Someone told me that it's a little different for E2-Visa-Holders and that I would still be considered a resident alien for tax reasons.
    Am I eligible to file 1040 and to exclude my German income by adding Form 2555(EZ) (Foreign earned Income Exclusion)? If not, why?

    You will file nonresident tax return for 2007. You will report only the income earned in the U.S.
