    Want to move out of state
    Hello eveyone. My question today is. I want to take my two children and move down to Alabama and I'm not sure on how the legal laws work with this. My daughter's father and I got a divorce 7 years ago and he doesn't see her all that often. He see's her maybe 5 times a year. My son's father is in the milatary. We have been separeted for 4 years now and has informed me that he will be going over seas in a year. He does spend every other weekend with his son and understands that I want to give the children a better life but doesn't want his son to move that far away. I can transfer with my job so I will have a job when I can move. But what do I have to do to get them down there to have a better life? Please help we really need to get out of here and move on with our lives.

    This is something that is decided by a family court. If the court feels you have good reason to relocation they will grant you permission to do so.

    However, the court will decision based on the children best interest. The first husband's case sounds weak, it's kind of difficult to state in court that you think the child say instate when you visit them only 5 days out of the year.

    But the second husband visits more often, and from what I gather he plays more of an active role in the children's lives. Plus, he is going overseas to fight for our country. Unless, he posed some type of danger to the children I don't see why a judge would allow it. The fact he is being shipped oversea is not going to be a negative.

    Before you try to battle this out in a court room, may a suggest you try to convince this ex-husband of yours to accept the move and then get it in writing. Try to reach someone compromise, if separate and my wife wanted to take the kids out of state, I would allow it depending on what state it was. I mean we are in New York, if she wanted to move to any of the neighboring state I would have a problem with it but if she told me she wanted to move to California I would strongly object.

    If there is a court ordered visitation agreement, then you can't move if it will interfere with that agreement without court approval. So get your arguments together and petition the court for a modification.
