If husband leaves is it abandonement?
After being evicted from our home my husband has moved himself in to a new home. I have no place to go and no way to pay for something so expensive. I do work, make about $1200.00 a month after car payment and insurance I have about $800.00 left. I cannot get my hands on enough cash for deposits, he also left all the outstanding bills in my name unpaid. I have asked him for assistance w/ finances and he laughs and says he is not responsible for me. Is he? How do I proceed w/ divorce and forcing him to help me financially?

In the divorce agreement the court will divide assets and tell him what he is and is not responsible for. Go for the divorce.

Get a lawyer to advise you on this predicament you are in. He is, hopefully, absolutely wrong. Everything is 50/50 in married life and he has to settle out his half of your finances and so do you. Get legal advise. Stay where you are for the time being until you get this straightened out. Live off what you have for groceries and only l/2 of the utilities and l/2 of everything else if you can get away with it for now.
Are the utility bills in his name only ? And how about the mortgage, in both names or only his? Are there children involved, that is a big concern for anyone ?

You may or may not be entitled to any money from him,
In most states in most cases, if you are working and he was working, all you should get is about 1/2

To proceede with a divorce then your going to have to file papers and have him served to get it going. At this point there is no relief until a judge can see it. You need a lawyer to get you through this and to see that it goes as smooth as possible ( mind you I didn't say easy ). Until there is a legal decree and judgment for the bench you need to do your best to stand on your own. It may take months or more to get total resolution so hang in there.

Yep he is not obligated to pay anything with your name and not his. Even with his name if he doesn't pay they come after you. You have to wait for the Judges ruling in the divorce.

You did not mention any kids in this picture, just you. If you have kids that's a different story. If it is just you, basically you are not going to be able to ask for any temporary alimony to get you back on your feet. Tough situation you are in.

No one addressed you initial question. If he moved into other accommodations and refuses to help support you then it should be considered abandonment.
Get an attorney and get working on things. In this case you can probably get him to pay for your legal bills. Shop around foran attorney who will defer payment.
