    I am on SSDI, a single mom w/an autistic child on SSI. After 3 hurricanes, I'm still struggling to get out of debt (all incurred during the hurricanes). I now have a collection agency ( who bought a CC debt) using an attorney to threaten me. Can they garnish my SSDI checks? I have both mine & my son's checks direct deposited into the bank. That is our only income. Can they still obtain a garnishment against my bank acct? The debt is $1,100.00. They would not even consider a re-payment plan. Should I close my bank actt?

    Your question then appears as a answer to someone else's question and you may not get an answer.

    Yes, as long as YOUR money goes into the account, they can freeze it, and it would then be up to you to show what money is what. You should consider sepreatig the money if you believe they will be getting a judgement in the near futre.

    Thank you for the advice. I clicked on "ASK" & for some reason it got piggy-backed. I'm new to this site & this was unintentional & I think my computer illteracy is showing, sorry.
    I hope I have time to transfer to a new account as S.S. requires at least 30 days to change check deposit/mail address. But here is my silly dilemma... if I open a new acct. at another bank I guess they can still try to garnish that. I see the Florida law (& Federal) does not permit garnishing of SSDI but I see what you mean-once it's in the bank it's just "money". I'm so frustrated with this weirdo C.C. & collection agency. I've always been excellent repaying debt but I had to buy a (cheap) front door with this one card and (Homeowners Ins. & FEMA are worthless) and PAID on the card 3X the charge of the door (never a late pymt) so I was basically was paying interest on interest. The attorney letter states a "principal" amt. of $800.00 and (this month) added "interest" of over $200.00. The door cost $300.00. I repaid them $920.00 (on time) but they kept tacking on member fees & interest until I almost went bankrupt (We still don't have a roof or hot water). This is now the new America it seems. We are NOT a democracy-we are sheeps for President Corporate Greed. The FEMA rep. saw me trying to cut tree limbs in my wheelchair-all I asked for at first was help to rebuild my ramp. I was told it was "beyond their scope of aid". Thank God for my church. It's not "God Bless America" it now is "God Help America". :(
