    Evicting Family
    My husband , our two children and I live in my mother in-laws house and have lived here for almost three years. We never had a written lease contract, only a verbal.

    It was agreed upon to pay rent once we got straightened out with our finances since we relocated an hour away from where we used to live. When some unexpected expenses came up it was agreed upon between my husband and his parents that we could stop paying rent in order to pay these expenses, which were medical and automotive.

    For strictly personal reasons we have been ordered to move out of this home unexpectedly and the personal reasons are all pointed to me because my in-laws and I just simply do not get along.

    Is this legal that they can just throw us out on the streets with no legal contract between us? If so how long do we have before we can actually be forced out of our home? I have gotten conflicting answers, as I know there is a law to protect the home owners but what laws are out there to protect us until we have the time needed to get the financing to move? My husband just had his job terminated due to his company going bankrupt and I only work part time.

    Any help or advice you could give would be greatly appreciated!

    I'm not entirely sure and the only way to get a more solid answer is to ask a lawyer in your area, but with out a contract your in laws are pretty much free to do as they please because your names are not attatched to the property in anyway. As far as how long they have to give you, in Indiana my husband and I had to get rid of a friend living with us and because there was no contract we only had to give him 48 hours. We didn't have to legally evict him just had to tell him to get out. We even called a lawyers office and the police station before hand to be sure we were legal to do it.

    You've been there 3 years. That's long enough to establish residency. But without a lease, they can terminate that residency at any time. Depending on your local laws depends on how much time they have to give you. At the most, it would be one full month. At the least it might be 7-14 days.

    There is no question that you have to vacate. The only question is how much time before they formally evict you.
