    Tax status for 2007
    Hi!

This site is really good and it's great to see so many people active and contributing to the community.

I had a question about my tax status for 2007.
I came to the US on F1 in 2004. My status changed from F1 to F1-OPT in August 2006.
In 2007, I worked in my company on OPT till August 14th. Then I went home to India, got my visa stamped and resumed working from October 3rd on H1B. As such, do I qualify as a resident or a non-resident (or, heaven help me, a dual status) for tax purposes in 2007?
Also, if you could please guide me regarding which forms do I need to file in either case, it would be a great help.

    Thanks,
Girl who hates filing returns :)

    You are a non-resident for 2007. File a 1040 NR.

    Hello Tax Expert!

Thanks for such a prompt response :)
It was extremely helpful. Could you please tell me one other thing too? Do I need to file the 8843 too? If so, what do I need to enter under "Name of institution attended in 2007", since I did not really go to school in 2007?

    Thanks again for your help,
Girl who hates filing returns :)

Yes, you should file the form. The institution is the school where you studied (the OPT is really regarded as an extension of your study).

    Have fun filing.
