    Filing status on MA tax return
    Hi Tax expert,

    The Massachusetts's law says that a married couple can not file a joint return if they do not have the same residency status in MA for tax year 2007. My question is if somebody (who moved to mass early in 2007 because of a job change) got married later in 2007 and brought their spouse from another country. Both will be considered as part year resident of MA but will have different dates of residency in MA and thus can not file a joint return? Is this true? Even the other spouse didn't work at all? Please help.

    You are both consaidered to be part-year residents and therefore you can file jointly on your MA return.
