    Child Abandonment
    I want to know if I can have my daughter's father's rights terminated for abandonment and if he even has any in the first place. The facts are as follows:

    1. She has his last name
    2. Birth certificate lists father unknown
    3. Paternity has never been legally established
    4. No child support order, visitation, or custody order has ever been filed.
    5. He has had no contact with her or me for over a year.
    6. But, he could contact. Knows where we live, work, and go to school. Knows all numbers to reach us. Just hasn't.
    7. I had a previous protective order against him that expired in February of 07 which is the last time he contacted us.
    8. I have no desire for support. He is a violent alcoholic. I just want the rights terminated on the legal stand point, so that I have full legal custody. I don't want any drunken disappearing acts going on with him and my daughter.
    9. I live in Maryland.

    I guess I just would like to know what the abandonment laws are. I have done a little research and can't find anything clear on what the exact law is and what has to happen in order to file. Thank you!

    ANSWER: Given the fact that paternity has never been legally established, your daughter's biological father has no legal rights and no legal responsibilities. In the eyes of the, until and unless legal paternity has been lawfully declared and established by one of the legally authorized means for doing so, the child has only one legal parent: YOU. Without legal paternity being established, the biological father is a "non-entity" so far as the law is concerned.
