    How do I stop a collection agency from garnishing my check ?

    They will use many scare tactics to make you pay, when you finally offer to pay they will say, sorry that isn't enough. Unless you get a summons in the mail to go to court, they haven't started that process yet, but they will keep on with the phone calls, the threats. Do not return their calls, do not have anything to do with them, they are absolute scum and will say anything to get your money. If they exceed their limit of insults,and find they are not getting anywhere with yhou then they will sell the debt to someone else, add interest, and the whole process continues on.

    This is my opinion and I have said it many times before on this board. I have been there and done it all.

    If they get a judgement, and they can not garnish any pay unless they get a judgement in court.

    Ways to stop a garnishment
    1. move to a state that does not allow garnishments of pay
    2. don't work for a paycheck
    3. pay the debt

    Actually a summons has to be served in some way - personal, substitute, nail and mail. Mailing doesn't "do it."
