    F-1 student for > 5 years - 1040nr or 1040?
    Hi everyone,

    I came to the US in sep 2002 and just started my OPT this January. I wanted to find out which tax form should I be using this year, 1040NR or 1040. If I can file as a resident alient i.e. 1040, do I still need to file 8843 with the IRS?

    Your exemption under the F-1 visa expire on 31 December 2006, so you should file Form 1040 as a resident alien.

    In this case, you need NOT file Form 8843.

    I have a similar problem. My entry july02 under f1 was changed to h1 (october 10, 07). Can I get any treaty exemption for jan - oct 2007? Can I even file a 1040NR?
