    International Divroce
    I am a US citizen who was married for 12 years . I now live in st. lucia and my ex still lives in the states. He was suppose to move here but decided not to leave his family. We have been separated for about 6 months now. And he refuses any separated for the family. Our 3 children have been living with me for the past six months. Before I left the States he signed an agreement about the children to have them in the summer time, every other christmas and it is equal responsible to get them back and forth as well as he has agreed to pay me 150.00 per week for child support. We got the paper notarized with 2 other witness. I know want a divorce because he has stated he will never leave his parents. Do I have to come back to the states or can I file without coming back?

    Your agreement with your ex pertaining to the children may be a viable plan, but probably not enforceable at this point. I think you should retain an attorney where he lives, if that is where you and the children lived with him. If you ever need the court to enforce the divorce decree, the court must have jurisdiction over him; and the court in St. Lucia probably lacks that jurisdiction.
