    Probation violation
    My husband was put on a 4 yr. probation in 2004 for possession of crack cocaine that was approx. 4grams. It's now 2008(he's probation is to end March 2008)and he's violated his probation due to our family having a complete down fall(having to live back with my parents)and due to him not being able to keep a job because of his felony background.My husband has stayed out of trouble these last 4 years but,he's been violated only because he hasn't seen his PO since 2006,and he(we) couldn't pay his fees when he was scheduled to see his PO.What should he do or what do you think is the outcome to this?

    Let me see, he has not paid his pobation fees, he has not reported to his PO in 2 years, moved without notifing his PO, and did not hold a job.

    So exacly what terms of it did he follow? He could have worked at McDonalds, or a video store or somewhere,

    I see jail time in his future. And when you say "only" this is a big deal, they do drug tests, and check in, there isno excuse for not showing up.

    I will assume they will feel that a time in jail will make him take probation a lot more seroiusly in the future, And expect a longer probation after he does get out of jail.

    I have been in a similar situation with my boyfriend, although the first offense was different but it was still a felony. My boyfriend absconded from his probation totally in Dec. 2005 because of failure to pay fines and he was too in a downward spiral. He just went to court and has to do 6 months. Maybe this will offer some help.

    Tai - what were you doing this entire time that you let your husband not to to the PO office and check in every month? Move and forget to tell them? Not pay his fees?

    When they do catch up to him, he will have to go before the judge who put him on probation and give a swell story. Maybe a nice story about how aliens abducted him might be more believeable than the truth... that he "couldn't go to the PO because he didn't have the money for the fees". Just because his probation is supposed to end in March 2008 does not mean it WILL END FOR HIM as he has not been doing his part of the probation requirements.

    The judge will hold a probation violation hearing for him and more than likely put him in jail for the amount of jail time he should have gotten in the first place. He just may put him back on probation and let him try again or he may not. It's up to the judge. No two cases are alike and no two judges are alike.
