    Washington Mutual foreclosure and bad contact information
    I will try to be short here. We own a home in Florida and through illness and job loss, we have become unable to make our payment. We are a victim of the infamous 'mortgage meltdown'. The lender is Washington Mutual. I called them a month before when I knew that I was not going to be able to pay the mortgage. They said to call back AFTER I was overdue to work out a payment plan. I waited until after the payment was due and contacted them with the details and attempted to work out a pymt plan. They sent loss mitigation papers. I filled them out and attempted to fax them in. The fax number on the accompanying letterhead was disconnected, as was the telephone number for the loss mitigation dept. I called the regular WAMU number and persisted until a chap finally gave me the fax number. The fax went through and I have not heard from that dept. This is over 2 weeks ago.

    Meanwhile, they continue to call me 2-3 times a day for debt collection. I am cordial and go through the entire story with them (the loss of job, the filling out of paperwork and the bad fax number, the eventual success of getting the fax out, the mailing back of the forms). I have not heard back from the loss mitigation dept, nor can I reach them by telephone. When I call the WAMU customer service number I am told to wait until they contact me. Meanwhile, I receive a pre-foreclosure letter demanding the payment in the mail today. I am one payment behind (due on the 1st), and of course, coming up again on the 1st of February for the 2nd payment behind. I would like to work out an alternative payment arrangement with the mortgage company, but to no avail. Does anyone out there have any info abot WAMU and/or their foreclosure processes and how to go about getting over this 'hump'. Getting to a 'live body' out there that knows who and how I might navigate this process? Thanks!

    You can contact me regarding the extreme problems at WAMU. I am considering filing several complaints and would share the filing contact information with you. I attempted to modify a loan starting in August 2008. They never ever spoke to me or responded in any way. I phoned every week for months and finally wrote to a V.P.

    I involved a lawyer. We have still made no progress.

    You have started a small step into an enormous problem. You will need legal assistance to combat their moves to foreclose and say they never heard from you once.


    Something to consider is that commercial banks are regulated by three agencies: the Federal Reserve, the Federal Deposit Insurance Corporation, and the Comptroller of the Currency. They are the ones responsible for enforcing banking regulations, and so would have the most direct impact. Here are the links for the consumer complaint offices of each:

    If it were me, I would file the complaints first, then say in the letter that you’ve done that, and cc the three agencies and the media, as well as state and federal representatives. (I would notify Feinstein as well as Boxer, and also your congresswoman, Lucille Roybal-Allard.
