    Les Pendence
    If a piece of land is transferred in June 07 and a Les Pendence is filed on 9/14/07 and the recorded deed date for the land transfer is on file as 9/21/07 will the Les Pendence be valid of can it be nullified. Is there any room for an opposing attorney to argue the validity of the Les Pendence based upon the difference in timeframe from June to September for the recorded deed date?

    If the effective date of the transfer is in June then the Les Pendens is valid, even if the transfer is recorded after its filed. However, if the legal action is against the former owner, then its not valid.
