    Breaking a rental lease
    I was in a motorcycle accident and need my son and his wife to move in and help take care of me. He has a one year lease which is up in April of 2008. Is there a way he can get out of it without losing his security deposit on his apartment? We live in Deland, Florida.

    Thank you in advance for any help that you may be able to give us.

    Unlikely. He can try and negotiate a buyout from the lease or sublet it.

    Actually he can lose a lot more than just the security deposit, they can require him to keep paying the rent on the apartment until it is rented again. Also if I remember correctly Florida does not even have to actively search for a new renter. Most do.
    Now if your son takes your medical info with him, perhaps a letter from the doctor stating you can not care for yourself. If he has a great landlord, they may let him out, if he has a good landlord they may let him buy the lease out but it still may be more than just the deposit.
    And if he has a poor landlord, he may as well expect to lose deposit and still get billed.

    Scott and the padre are both correct. Think of it this way, what did the landlord do cause himself financial harm? Nothing, he did no wrong and he is not party to your unfortunate situation so he should not shoulder anything. The lease is valid so negotiate with the landlord or explore subleting if the lease allows that.
