OK, I am 25 and my boyfriend of almost 4 years is 38. My son is almost 4 and has only known my current boyfriend as daddy. His bio daddy split for unknown reasons. I know exactly where he lives in fact when my son goes to his pop-pop's house weekend (which also happens to be where his bio father is currently staying) his bio has almost no contact with him AT ALL. His hides in his third floor room the whole weekend. I have mad every attempt to have him involved, if not necessarily as "daddy" at least as the coolest uncle ever who gets to spoil him. He hasn't paid support on a regular basis since my son was born and has completely disappeared more than once. Both times to different states... my boyfriend not only approached me when my son was about a year old but also my ex's parents whom I am still close with to this day and asked if he could have our permission to be my son's father. He wanted to be in my son's life forever and be there for him even if things didn't necessarily work out in our relationship. Now years later he has gone from not just wanting to be called daddy but has asked to legally adopt him. I think this is great and his bio grandparents think so too. I just don't know how to go about doing any of this. ANY advice would be greatly appreciated

Simple, you hire a family law attorney to prepare the adoption petititon. This petition needs to be filed in Family court. Part of the paperwork will be a relinquishment of rights by the bio father. Doesn't sound like he will object and since its to pave the way for adoption the court should approve it.

The only fly in the ointment I see is that you are not married. The courts do prefer a stable relationship. But the attorney can advise what is necessary for the local court.
