    Babies dads name is not on the birth certificate but his last name is on the baby
    My baby is due in about 5 weeks and I need to know if I put the babies dads last name on my baby but I don't put him down for the father and leave it unknown could he still fight for custody of my baby? We were never married and we don't live in the same state right now. But I need to know the answer right away because my baby is due very soon and I am very scared at the moment

    I would just put my last name on your future baby's. Then the father would not even know it was his or it would prove that you do not acknowledge him to be the father.

    You can name that baby whatever you want. First name, middle, or last. Does not matter what last name you give the baby, that is your choice.

    Now, should the father demand a paternity test, whether his name is on the birth certificate or not, he will be able to petition for visitation and/or custody if it is found that he is the father.

    I was told 4 almost 5yrs ago that I couldn't give my son his fathers last name unless his father was present. Might be different state to state but that's what NY and NC told me. I need to know cause my sons father travels with his job and he is active in my sons life and wanted his son to have his name. Check with your mid wife or ob they should be able to tell u
