    1099 tax forms F1 status
    Hi
    I am on CPT and just have started working on 1099. I would really appreciate if someone can answer following queries:

    1. What are the forms which I need to fill before actually getting paid?
    2. Do I need to fill W-9? If not any other form?
    3. Do I need to file taxes before December or there is some deadline before which I need to file my taxes for this quarter?

    Since you just started getting paid on Form 1099-MISC, it is likely you will owe little, if any, U.S. income taxes due to the low amount of money paid in 2005.

    You should review IRS Pub 519 to determine which tax return you should file (as a non-resident alien [Form 1040NR] or as a resident alien [Form 1040]). In either case, you will have to file Schedule C and perhaps Schedule SE (assuming you are on a H-1 or H-1B visa).

    The 2005 tax return needs to be filed by April15, 2006. If you made over $6,500 in 2005, you should make an estimated tax payment using Form 1040-ES by 15 January 2006 (or file the tax`return by 31 January 2006). If you fail to do either of these filings by the dates indicated and oyu owe over $1,000 in taxes, penalties and interest will be due.

    You should not have to file Form W-9, since your employer is generating the Form 1099.

    When I posted the answer below, I assumed that you already have a Individual Tax Identification Number (ITIN). That is what the W-9 is for, which I suspect you have already submitted.

    BTW, if you have a wife or any other dependents, they also need ITINs.
