Go to court, fight for custody. You could get into trouble for just taking your child without having custody.

    Hello josh:

You can go anywhere you like with your child as long as there's no custody arrangement...

I need to get something clear here. You say there is no custody agreement in place, but someone has to be responsible for the child. The child lives with someone. Its not clear, but it appears the child lives in the same household as the mother. Do you also live in that household?

That's what the correct answer will depend on. If the child lives with the mother and you take her away, then even without a court ordered custody/visitation you could get in some trouble if the mother fights the move. But if the child lives with you and you are the primary caregiver, then you are clear.

I would work at making your custody legal by filing in Family court to make sure there are no problems.
