    Custody/Giving up rights
    All right, so here is the deal. I have a three year old son with a man I was married to and then later divorced. We have been separated for over two years now, and he has not paid one cent in child support. I already have Sole custody from when we went through with our divorce, legally he is supposed to get 12 hours a month with him but he was in prison for the last five months. He just got out and hasn't asked to see him but will send a text every now and then asking if he is all right. I am getting re-married to a great guy in Septemper 08'. His job is relocating in a couple of months and I want to go with but my sons father won't let that happen. My son's father wants to give up all rights so that the child support won't rack up anymore. I want him to also! Does anyone know if you have to have someone that is willing to adopt before the other parent can give up rights? And in order to adopt does anyone know if you have to be married? What should I do to get through this? Thanks for the help!

    Hello minders:

    I think you can do everything you want. You're just going to need a family lawyer to do it for you.

    Cause if you do it wrong, well... it can cause all sorts of trouble.

    If your new partner is willing to adopt, then if the other bio parent gives up their right then their child supporrt will end.

    If the new spouse does not wish to adopt, then giving away rights does not stop the child support just gives away rights
