    Roommate Not On Lease
    I was the only person to sign lease with landlord, and I live in California. 6 months ago I took in a roommate, he never signed a lease. I have given notice to landlaod, and received a 60 day notice of termination of residential month to month tenancy. I am moving on the 1rst which legaly is the day I have to go. My roommate is saying he's not going to leave the house, even he never signed the lease, and has only been here a short time. I've been here 2 yrs. 6 mo. Paying $2500.00 monthly, the border I took in only pays $700.00 monthly. What are my rights, I do not want to lose my deposits.

    Ok, the roommate is YOUR tenant, so its YOUR responsibility for removing him. You have to give him notification of the lease termination and, if he refuses to move you have to file eviction proceedings. You will then be responsible for paying the rental if the eviction goes past your termination date.

    I would explain the situtation to the landlord and see if he is willing to offer a lease to the roommate. That would get you off the hook.
