    Is this legal?
Someone who doesn't like me, pulled my driving record and emailed it to members of the church with the intentions of causing harm to me in the face of the other members. Is this legal or harassment. I understand that the records may have been public information, but Im sure she had to pay to pull them up and I am ill that she would do this and share it. The bad thing is, is that what she is sharing of my records are of a recent wreck in which the charges have not been taken to court yet and one of the charges is pending and will probley be removed from my records. What can I do? Does she have the right to do this to me legally?

That was really nasty. But how did she do that. In Ontario one can't do that through the DMV unless they have a constable in the service to do it for them and even then if anyone found out that constable would be in serious trouble and suspended.

These records aren't public information here, so how can they be in the US. Otherwise so many people would be in jeopardy.

The more I hear here, the more I am happy I don't live in the US any longer.

I would call her bluff; she can't do that legally.

Contact your local department of motor vehicles. While driver records may be accessible by the public access to them is often only granted for a specific purpose which must be declared on a request for information form.

Such reasons may be an employer checking on a potential driver or a legal professional acquiring information for the purposes of a lawsuit. It may be illegal to use the acquired information for anything other than the declared purpose.

Your first step as Justice stated is to determine whether she could legally obtain this info. If she did legally obtain the info, then you need to determine if it was legal to distribute that info. It may be legal to obtain the info but only for limited purposes.

Once you have determined those facts you can then determione whether you have a civil case against her.

You should also talk to your minister. Whether what she did was legal or not it wouldn't be considered "christian" and it may backfire on her.

    Hello c:

I don't think your driving record IS public information. Even if it is, I'm not sure that you don't have a case for "intentional infliction of emotional distress".

Call up a few lawyers on the phone. You'll find out, and you might even find a lawyer to represent you.
